If your TUIfly flight arrived more than 3 hours late, you may be entitled to compensation of up to €600 under EU Regulation EC 261/2004. When are you entitled to TUIfly compensation?

EC 261/2004 applies when all of the following conditions are met:

Flight conditions:

  • Your flight arrived at its destination 3 hours or more late (measured from the moment the aircraft doors open, not departure time)
  • The flight departed from an EU airport — all TUIfly departures from Germany are covered
  • Or the flight was operated by TUIfly (EU-registered) arriving into the EU

Passenger conditions:

  • You had a confirmed booking
  • You checked in on time
  • You were not travelling on a free or non-publicly available discounted fare

TUI AG vs TUIfly — who is responsible? This is the most common source of confusion for package holiday travellers. TUI AG is the tour operator; TUIfly is the operating airline. For EC 261/2004 compensation, the operating airline is always responsible — that means TUIfly. This applies regardless of whether you booked through TUI directly, a travel agency, or an online portal. Hotel or transfer complaints go to the tour operator TUI; flight compensation goes to TUIfly.

TUIfly compensation amounts

Compensation is based on flight distance:

  • Hamburg – Gran Canaria (~3,200 km) → €400 per passenger
  • Düsseldorf – Egypt (Hurghada) (~3,580 km) → €600 per passenger

How to claim TUIfly compensation — step by step

Step 1: Check your eligibility

Determine:

  • Did your flight arrive 3+ hours late?
  • Was the cause not an extraordinary circumstance (no extreme weather, no security incident)?
  • Was TUIfly the operating airline (not just the ticket seller)?

Step 2: Gather your documents

Prepare:

  • Booking reference (PNR) or TUI booking number
  • Flight number (e.g. X3 2104)
  • Boarding pass or booking confirmation
  • Proof of actual arrival time (Flightradar24, FlightAware)
  • Bank account details (IBAN)
  • For package holidays: TUI booking confirmation as additional evidence

Step 3: Submit your claim to TUIfly

Go to tuifly.com → Customer service → Passenger rights → Compensation claim. Alternatively, submit through the TUI service portal. Save the confirmation number.

Step 4: Wait for a response

Expect 6–12 weeks processing time. During peak season (summer, Christmas), it may take longer. No response after 12 weeks? Time to escalate.

Common excuses TUIfly uses to refuse claims

1. "Extraordinary circumstances" The standard defence. TUIfly cites weather at resort destinations (storms in Turkey, sandstorms in Tunisia, volcanic ash). Check: did the weather actually affect your specific flight? Tight rotations and delays from previous flights are often the real cause — and those are not extraordinary circumstances.

2. Seasonal overload pressure TUIfly operates with extremely tight turnaround windows. When the first flight of the day is delayed, the delay cascades through the entire daily schedule. This is not an extraordinary circumstance — it's an operational planning issue.

3. Redirecting to TUI (the tour operator) TUIfly often tells package holiday passengers to contact TUI. Don't be sidetracked: EC 261/2004 compensation is always directed at the operating airline — TUIfly.

4. "Charter flight — different rules" Wrong. EC 261/2004 applies to all flights departing from EU airports — scheduled, charter, or holiday flights alike. There is no charter exception.

What if TUIfly offers vouchers instead of money?

TUIfly and parent company TUI regularly offer travel vouchers as "compensation". What you should know:

  • You have the legal right to cash payment — you do not have to accept vouchers
  • TUI vouchers often apply only to TUI holidays and have expiry dates
  • Accepting a voucher may extinguish your cash claim
  • Voucher values are often below the statutory compensation amount

State clearly: "I decline the voucher and demand cash compensation under EU Regulation 261/2004."
